Read This Before Getting Started
Please read these Policies and Procedures before entering into a project with BGard Graphics. By starting a project with BGard Graphics or purchasing any consultations, strategy sessions, clarity calls or any of our digital products through our online store, you are consenting to be bound by the terms of these policies and procedures. These policies and procedures can be changed or updated by BGard Graphics at any time without prior notice. All designs remain the property of BGard Graphics until paid in full and approved as final by the client. BGard Graphics retains the right to use all completed projects in/on portfolio, website and any advertising as seen fit.
Confidentiality & Non Disclosure
BGard Graphics acknowledges that it may receive or have access to information which relates to the client’s past, present, or future products, vendor lists, creative works, marketing strategies, pending projects/proposals, and other proprietary information. BGard Graphics agrees to protect the confidentiality of the client’s proprietary information and all physical forms thereof. Unless strict confidentiality is requested by client in advance of the establishment of this agreement, BGard Graphics reserves the right to display materials and final work created for client on the BGard Graphics website, portfolio, social media or any other printed or digital publications.
Payments & Deposits Policy
BGard Graphics accepts payments via PayPal invoice and through online booking portal of consultations, strategy sessions and clarity calls on www.bgardgraphics.com. A 3.5% debit/credit card processing fee is added to all PayPal invoices. Other forms of payment accepted are money order or check. Please note that the preferred and most convenient method of payment is PayPal, however, in the event that the client needs to pay with a check or money order, please be advised that project commencement will not take place until check has been cleared and/or money order has been received.
Prior to project execution, a non-refundable deposit is required to secure design services. A deposit request/invoice is emailed to you prior to the start of the project and payment is due before any work can start. Projects estimated to be $250 or less require payment in full prior to project execution. Projects estimated to be $251 or more require a 50% deposit prior to project execution. Clients may pay a 25% non refundable deposit to secure a spot on our design schedule. Another 25% deposit will be required at least one week prior to the scheduled start date of the project. The remaining 50% balance and final payment is due at time of project completion. Once the balance has been paid in full, final design project files will be delivered electronically to the client within 24 hours of final payment.
For larger projects that will be performed over and extended period of time (2 months or more), a minimum 50% non refundable deposit is required to secure design services and a milestone or retainer fee schedule payment may be proposed and accepted by both parties. The deposit amount on these projects is determined upon the scale and size of project but it will require a minimum 50% deposit.
Cancellation & Refund Policy
Clients can make cancellations at any time but due to the nature of design process and our digital products, please keep in mind that the deposit is non-refundable and the client will forfeit their deposit or any payments made up until the point of cancellation. No cancellations or refunds accepted on special offers once payment has been received.
Client will provide all content (pre-edited if necessary) to be used in any design project unless otherwise negotiated. All text supplied must be typed (DOC, TXT or via shared editable Google Doc). Client agrees to provide copy and any other submissions prior to project start date. BGard Graphics will not be held responsible for unedited content that goes undetected and makes it to final draft submission or goes to press.
BGard Graphics may make changes to this website regarding pricing, services and information such as specifications, promotions and product offerings at any time and without notice.
Estimates and/or Quotes
Estimates or quotes are only valid for 14 days from send date, as noted on quote document unless otherwise noted on the quote or agreement between you (the “client”) and BGard Graphics, LLC (the “designer”). After 14 days the quote will be considered no longer valid and the client will need to request a new quote.
Sustaining good communications with our clients is crucially important to the creative process and ensuring that design projects are completed by their estimated deadlines. Both parties are expected to communicate effectively in a clear and timely manner to help us to understand the client’s specific needs. BGard Graphics supplies clients with a project timeline and the client is given clear time frame in which their feedback or any elements that could impede the design process is due. Copyrights and Trademarks
The client represents to BGard Graphics and unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, or other artwork furnished to BGard Graphics for inclusion in design projects are owned by the client, or that the client has permission from the rightful owner to use each of these elements, and will hold harmless, protect, and defend BGard Graphics from any claim or suit arising from the use of such elements furnished by the client.
Initial Contact & Consultations Policy
The initial contact is to ascertain the needs of the client’s project and for the client to become more acclimated with BGard Graphics. Service as a consultant does not require BGard Graphics to be an advocate for any brand or its products in any forum, public or private. All of our clients shall submit their general project request via our project request form provided via their customer portal. If you do not know how to acccess your customer portal, please contact us here at email@example.com. After client’s project request has been received, a quote will be sent to the client within 72 hours of project request submission. For all branding project request, client must first request a 20 min discovery call here: https://thisisbrittany.com/booking/ and then we will assess how we should move forward. For all branding projects, up to a 90 minute branding consultation is required only after your scheduled discovery call and we determeine we are a great fit to work together. Branding consultations are $150 non refundable fee and must be paid at the time of booking via the link that will be provided to the client. All consultations are phone consultations. In person consultations are NOT available at this time. The purpose of the consultation is to discuss the specific project needs, such as but not limited to visual style and color schemes, target audience etc. In some special cases, if consulting is over the one hour consultation, then special pricing will apply and will be agreed upon between BGard Graphics and the client.
During our 20 minute brand discovery calls, NO 1 on 1 consulting or strategy will be provided. This call is to strictly introduce your business, learn more about our process and discuss how how we may be able to assist your branding needs.
Project Procedures, Completion & Execution Process
The project process starts with the initial contact with BGard Graphics followed by a brief phone call and quote supplied to the client within 3 business days of initial contact for approval. Client approves quote and signs graphic design services agreement. An invoice will then be sent to the client via email and the client will make non-refundable deposit and the project is placed into production. Any deviation from the proposed schedule/timeline by the designer means the designer should notify the client immediately upon noticing a deviation that may take place.
During the design process, the designer may need feedback or additional materials from the client prior to moving forward to the next phase of the project. The client is required to respond to all such request within 48 business hours of such request or by the time frame given in writing by the designer.
All project drafts or concepts created by BGard Graphics not selected as the final project design remains the property of BGard Graphics. BGard Graphics reserves the right to use any concepts in other projects without obligation. No project is deemed final by BGard Graphics until a payment invoice has been sent.
All project revisions specifications are outlined in the client's original quote and/or scope of work from BGard Graphics. Once the client approves the final project design and submits final payment the project process is complete. After client approval, if the client requires a minor revision, this revision request must be submitted within 24 hours from time of approval. At this time minor revisions can be made up to the agreed upon number of revisions. Any revision requests after this alloted 24 hour window is subject to additional fees. If revisions beyond the agreed upon number of revisions are required, an additional fee will apply.
Projection Completion and Delivery
Once the client approves the final project, the final files will be delivered electronically via Google Drive. The client will have 7 days from the date of notice of completion to download your final project files. After 7 days your files may be no longer accessible. BGard Graphics is not obligated to provide you with additional files after 7 days from project completion.
BGard Graphics reserves the right to reject projects at anytime or refuse services to any order, person or entity, without the obligation to assign reason for doing so. You will be notified by email if your order will be rejected or cancelled. No project is deemed accepted by us until a payment invoice has been sent and a professional graphic design services agreement has been signed by both parties.
BGard Graphics will make every effort to communicate and reach out to the client for necessary feedback and project continuation. In the event that BGard Graphics has not received proper response or communication from the client within 14 days, the project is considered abandoned and will be cancelled. The client will not have any rights to use any of the work that was presented by BGard Graphics, unless the project has been paid in full. If we have not received proper communication from the client and the client contacts BGard Graphics after the 14 day abandonment period, a start up fee of $75 will apply and be due prior to continuation of project design services.
Turnaround Times & Rush Fees
Typically, most projects with the exception of branding projects, are estimated to take 7 to 10 business days. Some project requests that are requiring several design pieces at once may require longer than the standard 7 - 10 business days. If the client is requesting for a turnaround time that is less than 7-10 business days, a rush fee will be applied for projects that require rapid completion. If the client is requesting a turn around time that is not possible by BGard Graphics, the project will be rejected. The rush job fee is determined on a project to project bases and will be agreed upon prior to project execution.
Bigger projects such as logo, branding, and website design require more time and estimated turnaround time is provided to the client based on the client’s project specifications.
BGard Graphics subcontracts all print work and will not be held responsible for printer delays in printing. Printing costs will be estimated separately unless originally discussed and included in design fees. It is the responsibility of the client to allow enough time for all printed marketing collateral to be designed and printed.
BGard Graphics will make every effort to ensure the final job is free of any misspellings, punctuation or formatting issues. Prior to print all clients will have the opportunity to review/proofread each job to ensure accuracy. Once the job receives approval for print it is sent to the printer and NO CHANGES MAY BE MADE. We are not responsible for any misspellings, punctuation or formatting issues after the client has given their last and final approval.
The client understands that it is the client’s responsibility to trademark the logo design. For more information on copyright and trademark visit the following link: www.copyright.gov and/or seek trademark at www.uspto.gov/main/trademark
Due to the nature of logos, source files are included as a deliverable upon completion of project. For other projects which do not require an editable file, source files will not be given or included as a part of the final deliverable. If the client request a source file, an additional fee will be applied and determined upon complexity and usage of source file. BGard Graphics reserves the right to deny or refuse to give any source files. Keep in mind that client owns the final overall design and may not utilize or claim any individual elements within the overall design unless otherwise specified.
NOTE: Before you confirm your agreement to these terms, please make sure you understand all of the above agreement. Should you have any questions or concerns regarding these terms, please contact us before advising us of acceptance. By signing your name or likeness and submitting the agreement box, you consent to the terms of your design agreement as well as all BGard Graphics terms, conditions, policy and procedures not covered in the agreement on behalf of yourself, and/or your organization or business. BGard Graphics WILL NOT be culpable for any loss, damage, misrepresentation or misprint of a design resulting from not understanding terms and conditions.
